Terms of Service

By accessing or using PartiesNearMe ("Service"), you confirm that you have read, understood, and agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Service.

These Terms constitute a legally binding agreement between you and PartiesNearMe, operated by Maurício Amaro.

PartiesNearMe is a nightlife event discovery platform that aggregates publicly available event information from third-party sources and allows event promoters to list their events. The Service provides:

• Real-time maps of nightlife events in cities worldwide
• Curated nightlife guides and blog content
• Event promotion tools for venue owners and promoters
• City-specific neighborhood and venue information

We aggregate event data for informational purposes. Event details, dates, prices, and availability are subject to change and should be confirmed directly with the event organizer or venue.

You must be at least 18 years old to use PartiesNearMe. By using the Service, you represent and warrant that you are 18 or older and have the legal capacity to enter into this agreement.

If you are using the Service on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

To access certain features (event saving, push notifications, event promotion), you may sign in using Google OAuth. You are responsible for:

• Maintaining the security of your Google account
• All activity that occurs under your PartiesNearMe account
• Notifying us immediately of any unauthorized use at mauriciopachecoamaro@gmail.com

We reserve the right to suspend or terminate accounts that violate these Terms.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Submit false, misleading, or fraudulent event information
• Scrape, crawl, or systematically extract data from the Service without our written permission
• Interfere with or disrupt the Service or its servers
• Attempt to gain unauthorized access to any part of the Service
• Use the Service to spam, harass, or harm other users
• Violate any third party's intellectual property rights
• Impersonate any person, venue, or organization

If you submit an event for promotion on PartiesNearMe, you additionally agree that:

• You are the organizer, promoter, or authorized representative of the event
• All event information you provide is accurate, complete, and not misleading
• You own or have the rights to all images and content you submit
• The event complies with all applicable local laws, permits, and regulations
• You will promptly notify us if event details change materially (date, venue, cancellation)

We reserve the right to reject, edit, or remove any event listing at our sole discretion, including listings that contain inaccurate information, violate these Terms, or are inconsistent with our editorial standards.

Event promotion fees are processed through Stripe. All fees are displayed clearly before checkout. By completing payment, you authorize us to charge the stated amount.

Refund policy. Promotion fees are generally non-refundable once an event listing has been activated. Exceptions may be made at our sole discretion in cases of:

• Duplicate charges due to technical error
• Failure to publish the listing within the agreed timeframe due to our error

We are not responsible for Stripe's processing fees or any bank charges you may incur.

All content on PartiesNearMe that is not user-submitted — including but not limited to the logo, brand name, website design, editorial content, blog articles, and underlying code — is owned by or licensed to PartiesNearMe and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from our proprietary content without our express written permission.

The PartiesNearMe name and logo are trademarks of PartiesNearMe. You may not use our trademarks without prior written consent.

By submitting content to PartiesNearMe (event listings, images, descriptions), you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute that content in connection with operating and promoting the Service.

You represent and warrant that you own or have the necessary rights to submit the content, and that the content does not infringe any third-party rights.

We do not claim ownership of your submitted content.

The Service may contain links to third-party websites, venues, event ticketing platforms, and other services. These links are provided for convenience only. We do not endorse or control third-party content and are not responsible for the accuracy, legality, or practices of any third-party site or service.

Your interactions with third-party services are governed by their own terms and privacy policies.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, error-free, or free of viruses
• Event information (dates, times, venues, prices) is accurate or current
• Any errors will be corrected

Event details are aggregated from third-party sources and may not reflect real-time changes. Always verify event information directly with the venue or organizer before attending.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARTIESNEARME SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

Our total aggregate liability to you for any claims arising under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim, or USD $50, whichever is greater.

You agree to indemnify, defend, and hold harmless PartiesNearMe and its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; or (c) your violation of any third-party rights, including intellectual property or privacy rights.

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that violates these Terms or is harmful to other users, third parties, or the Service.

You may stop using the Service at any time. To request account deletion, email mauriciopachecoamaro@gmail.com.

Sections 8, 9, 11, 12, 13, and 15 of these Terms survive termination.

These Terms are governed by and construed in accordance with the laws of Brazil, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in São Paulo, Brazil, for any dispute arising from these Terms or the Service.

If you are a consumer in the European Union or United Kingdom, you may also have the right to bring a claim in the courts of your country of residence under applicable mandatory local law.

We may update these Terms from time to time. We will notify you of significant changes by updating the "Last updated" date at the top of this page. Where required by law, we will provide more prominent notice. Your continued use of the Service after changes become effective constitutes your acceptance of the updated Terms.
